Terms and Conditions of Sale



Article 1: Application of General Sales Conditions

The present general sales conditions are concluded between Phil Boogie Times and the CLIENT, either a natural or legal person, for any acquisition of goods or services through the Phil Boogie Times website, referred to as www.philboogietimes.com. These conditions must be accepted without reservation by the CLIENT before any order and cannot be challenged once the order is validated by the CLIENT. Phil Boogie Times reserves the right to modify its general sales conditions, without prior notice. In such a case, the general sales conditions in force at the date of validation of the order by the CLIENT shall apply. These present general sales conditions prevail over any other general or specific conditions not expressed herein and agreed upon by Phil Boogie Times.

Article 2: Purpose

The present general sales conditions aim to define the rights and obligations of both parties, Phil Boogie Times and the CLIENT, for any acquisition of goods or services via the WEBSITE.

Article 3: Prices

3.1 Product Prices
The prices of our products are indicated in Euros VAT included and are subject to change at any time without notice. However, invoicing for a product will be based on the price in effect at the time of the order. The total price of the order is to be paid in Euros only, at once and in full.

3.2 Packaging & Shipping
Packaging and shipping costs are not included in the prices of the products. They are reminded before order validation (possible choice) and are the responsibility of the CLIENT.

3.3 Other Possible Fees
Any customs fees or local taxes for shipments outside Metropolitan France are the responsibility of the CLIENT. Any product remains the property of Phil Boogie Times until full payment of the order.

Article 4: Product Availability

4.1 Products in Stock
Any product on the WEBSITE is available and can be ordered within the limits of available stocks, unless otherwise indicated. Replenishments may possibly be made upon specific request from the CLIENT via email. However, the WEBSITE cannot commit to replenishment times.

4.2 Reservation
Any product can be reserved by email. When a CLIENT reserves a product, said product is removed from sale by the WEBSITE. Reservations must be paid within 7 days, even if the CLIENT wishes the WEBSITE to retain the product(s) for a later grouped shipment. Otherwise, the reservation will simply be canceled, and the product put back on sale.

4.3 Unavailability
In case of unavailability of a product once the order has been validated by the CLIENT, the WEBSITE will contact them by email as soon as possible. The WEBSITE will propose an exchange for another product of equal value or a refund of the value of the unavailable product.

4.4 Refund
In accordance with Article L121-20-3 of the Consumer Code, Phil Boogie Times has a period of 30 days to proceed with a refund. The refund will be made to the CLIENT in the form of a credit to their bank account (secure transaction) for payments made by credit card, a credit to their PayPal account (secure transaction) for PayPal payments, or by check in other cases.

Article 5: Product Compliance

5.1 Product Condition
The products offered by the WEBSITE are new or second-hand.
The mention "second-hand" is indicated on the pages of the relevant products under the title: "General Condition".

5.2 Additional Information on Products
The photographs of the articles on the WEBSITE are presented for information purposes. They may not perfectly match the Product ordered. Therefore, no claim based on a discrepancy between the received Product and the photo will be accepted. In case of doubt, it is possible to contact the WEBSITE.
In case of a significant difference with the presented article or the presence of a characterized element on the article, the WEBSITE will contact the client to inform them before continuing the ordering process.

5.3 Non-Conforming Products
The WEBSITE undertakes to exchange any defective or non-conforming product for the CLIENT. To do so, the client must:
- describe the defective or non-conforming product in detail via email.
- return the defective or non-conforming product in careful and suitable packaging, ensuring the physical integrity of the product during transport.
The products are to be returned via Colissimo to Phil Boogie Times - 190 rue d'Evere - 84820 VISAN – FRANCE.
Any claim that does not meet the aforementioned conditions will not be accepted.

Article 6: Payment Terms

6.1 Payment Methods

6.1.1 Bank Transfer
Transfers are to be made, preferably within 2 working days from the validation of the order, to Phil Boogie Times at the following account:

6.1.2 PayPal
Debit from your account is effective upon placing the order.

6.2 Processing / Shipping
Orders are shipped once payment is received and after any verification of the data provided by the client.

6.3 Order Suspension
The WEBSITE reserves the right to suspend the management of an order as well as its delivery in the following cases:
- non-payment of the order by the CLIENT
- refusal of payment authorization by authorized organizations
- previous unpaid or partially paid order by the CLIENT
- ongoing payment dispute with the CLIENT

6.4 Data Verification
The WEBSITE reserves the right to request from the CLIENT the necessary evidence justifying their status as the effective holder of the bank card used for payment. This information may be transmitted to a third party for verification, as part of the fight against internet fraud.

6.5 Invoice
If the CLIENT wishes, by simple email request, they can demand a detailed invoice of their order which will be sent to them as soon as possible by email or in paper format, enclosed in their package.

6.6 Late Payment Penalties
In the absence of payment within one month from the date of payment indicated on the invoice, the CLIENT must, in addition to payment of said invoice, pay late penalties set according to the legal rate in force in 2012. This amounts to a sum equivalent to 2.13% of the total amount of the invoice.

Article 7: Delivery

7.1 Carrier
Deliveries are ensured by La Poste services in Metropolitan France with Colissimo, Mondial Relay. Shipments outside Metropolitan France are handled by Colissimo and UPS.

7.2 Delivery Methods
The products will be delivered to the address indicated by the CLIENT during their order.
The CLIENT is required, upon receipt of the order, to check the physical integrity of the parcel / packaging. If the parcel is damaged, the CLIENT must refuse delivery, request a return to the WEBSITE, and contact us by email or phone to inform us. A new parcel will then be sent to them as soon as possible. However, they may also claim cancellation of their order.
No returns, other than those provided for in Article L 121-20 of the Consumer Code, will be accepted by Phil Boogie Times after the CLIENT has signed the receipt of the parcel, confirming acceptance of the delivery.

The WEBSITE cannot be held responsible for a stolen parcel, damaged during transport, and/or defective products. However, if the CLIENT faces any of these cases, they should inform Phil Boogie Times and take steps to seek recourse from the carrier.

7.3 Delivery Times
Delivery can range from 1 to 6 working days for France and from 1 to 30 working days for abroad from the validation of the order. This is an average time depending on the destination, shipping method, and availability of the item. Delivery times are indicative only; their exceeding cannot lead to any cancellation of the order, reduction of the price paid by the CLIENT, or payment for damages, provided the CLIENT is delivered within 30 working days, which is 21 working days following confirmation of their order.

Article 8: Right of Withdrawal

8.1 Legislation
In accordance with Article L 121-20 of the French Consumer Code, the CLIENT has a period of 7 working days to exercise their right of withdrawal, without having to explain their reasons. This period runs from the day of receipt of the order for goods or acceptance of the offer for services by the CLIENT. If this period expires on a Saturday, Sunday, public holiday, or non-working day, it is extended until the following working day.

8.2 Return Procedure
Any return must be notified to Phil Boogie Times by email or phone.
The products are to be returned via Colissimo to Phil Boogie Times - 190 rue d'Evere - 84820 VISAN – FRANCE.
Any product must be returned in its original conditions (packaging...), as it was sent by the WEBSITE.
Sealed products (under cellophane) can only be exchanged / returned if they are still sealed and in perfect condition. Any product whose packaging has been opened or damaged and is no longer in perfect condition for resale cannot be refunded or exchanged.

8.3 Exchange / Refund
If the CLIENT exercises their right of withdrawal, they can decide on the refund or an exchange of equal value for their order. In the case of a refund, the entire order, including shipping costs, will be refunded. Only the return costs remain their responsibility.
In the case of an exchange, the re-shipping costs and return costs will be at their expense. In accordance with Article L121-20-3 of the Consumer Code, Phil Boogie Times has a period of 30 days to proceed with a refund. The refund will be made to the CLIENT in the form of a credit to their bank account (secure transaction) for credit card payments, a credit to their PayPal account (secure transaction) for PayPal payments, or by check in other cases.

Article 9: Intellectual Property

All texts, comments, and other written productions present on the WEBSITE are strictly reserved under copyright and intellectual property rights worldwide. Thus, in accordance with the provisions of the intellectual property code, any reproduction or representation, in whole or in part, of the WEBSITE or any other element therein, without prior authorization from Phil Boogie Times is strictly prohibited.

Article 10: Liability

The WEBSITE cannot be held responsible for the non-compliance, by any product whatsoever, with the legislation of the country where the order is delivered (prohibition of one or more titles, groups, albums, etc.). It is the CLIENT's responsibility to check with local authorities the conditions and possibilities of importation or use of the products or services they wish to order. Phil Boogie Times cannot be held liable, in the online sales process via its WEBSITE, for any damage suffered due to the use of the internet network (data loss, viruses, hacking, or any other problem of this nature).

Article 11: Applicable Law

All clauses in these General Sales Conditions are subject to French law. In the event of a dispute or complaint, the CLIENT will first contact Phil Boogie Times to agree on an amicable solution. Otherwise, any dispute or complaint will be governed by the authorized Courts.

Article 12: Data Protection and Privacy

The information and data concerning the CLIENT are necessary for the processing of their order. This information remains strictly confidential. However, they may be transmitted to Phil Boogie Times' contractual partners for order processing (carrier for shipment, bank for verification, in the context of the fight against internet fraud) and for the operation of the site by its host CDandLP Music Web Service.
In accordance with the French Data Protection Act of January 6, 1978, the CLIENT has the right to access and rectify the information concerning them and appearing in the files of Phil Boogie Times, by simple request by mail.
